This website is operated by Hugo Durand, sole proprietor (auto-entrepreneur) registered in France under SIRET 92077979000020, trading as CLEARAZUR (the "Brand"). Throughout the site, the terms "we", "us" and "our" refer to Hugo Durand operating under the CLEARAZUR brand. We offer this website, including all information, tools, and digital products available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, customers, and contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or purchase any products.

Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products to you.

SECTION 1 — ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or that you are the age of majority in your country of residence and have the legal capacity to enter into a binding agreement.

You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to copyright laws) in your use of the Service.

You must not transmit any worms, viruses, or any code of a destructive nature.

A breach or violation of any of these Terms will result in immediate termination of your access to the Service.

SECTION 2 — PRODUCTS AND DIGITAL DELIVERY

CLEARAZUR sells digital products including, without limitation, color grading tools (LUTs, PowerGrades, DCTLs), reference footage, installation guides, and related digital assets (collectively, the "Products").

All Products are delivered electronically via download link sent to the email address provided at checkout, immediately after successful payment. No physical goods are shipped.

We have made every effort to display as accurately as possible the colors, images, and visual results of our Products. However, color rendering depends on your monitor, calibration, software version, source footage, and grading workflow. We cannot guarantee that the visual results obtained on your system will exactly match those shown on our website or marketing materials.

We reserve the right, but are not obligated, to limit the sale of our Products to any person, geographic region, or jurisdiction. We reserve the right to discontinue any Product at any time. All Product descriptions and pricing are subject to change without notice, at our sole discretion.

SECTION 3 — PRICING AND PAYMENT

All prices are displayed in Euros (EUR) unless otherwise specified. Prices include applicable VAT where required by law.

Payment is processed securely through Shopify Payments and authorized third-party payment processors. We do not store credit card information on our servers.

We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to orders that appear fraudulent, are placed by resellers, or contain pricing or product information errors. In the event of cancellation, any payment received will be refunded in full.

SECTION 4 — NO REFUNDS / FINAL SALE / WAIVER OF RIGHT OF WITHDRAWAL

All sales are final. No refunds, exchanges, or cancellations will be granted once the order is placed and the download link has been delivered.

By completing your purchase, you expressly acknowledge and agree that:

  1. The Products are digital content delivered immediately upon payment;
  2. You expressly request immediate access to the Products and download them prior to the expiry of any statutory withdrawal period;
  3. You expressly waive your right of withdrawal (right of retraction) under Article L221-28, 13° of the French Consumer Code (Code de la consommation), which permits the exclusion of the right of withdrawal for the supply of digital content not delivered on a tangible medium when performance has begun with the consumer's prior express consent and acknowledgment that the right of withdrawal is thereby lost;
  4. Once the download link has been issued, the Service is considered fully performed.

Refunds will only be considered in the following limited cases:

  • The download link is technically broken and cannot be resolved within a reasonable timeframe after we have been notified;
  • The Product file is corrupted and a working replacement cannot be provided;
  • A duplicate order was placed in error and no download has occurred.

Refund requests must be sent to hurud.studio@gmail.com within 14 days of purchase, with proof of issue. Refunds, when granted, are issued to the original payment method.

We do not offer refunds for:

  • Compatibility issues with software versions, operating systems, or hardware not listed in the Product specifications;
  • User error in installation or application;
  • Dissatisfaction with creative or aesthetic results;
  • Change of mind.

SECTION 5 — LICENSE AND INTELLECTUAL PROPERTY

All Products sold on this website are protected by copyright and remain the intellectual property of Hugo Durand / CLEARAZUR.

When you purchase a Product, you are granted a non-exclusive, non-transferable, worldwide, perpetual license to use the Product for the following purposes:

  • Personal projects;
  • Commercial client work, including but not limited to films, commercials, music videos, social media content, and corporate productions, where the Product is applied as part of the color grading process to footage owned by you or your client.

You may NOT, under any circumstances:

  • Resell, redistribute, share, sublicense, lease, lend, or transfer the Products, in whole or in part, in their original form or in any modified form;
  • Include the Products as part of a bundle, pack, course, tutorial, or any other commercial offering for resale or free distribution;
  • Upload the Products to any public, private, or shared platform, server, cloud storage, or peer-to-peer network from which they could be downloaded by third parties;
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to extract or replicate the underlying algorithms, formulas, node structures, or color science of the Products with the intent of creating a competing product;
  • Claim authorship or ownership of the Products;
  • Use the Products in any way that infringes on third-party rights or applicable laws.

Any breach of this license clause results in immediate termination of your license and may give rise to legal action, including claims for damages and injunctive relief.

The CLEARAZUR brand, name, logo, visual identity, website content, marketing copy, photography, and footage remain the exclusive property of Hugo Durand and may not be reproduced, distributed, or used without prior written authorization.

SECTION 6 — ACCURACY OF BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store, including a valid email address to receive your download link. We are not responsible for failed delivery resulting from incorrect or incomplete information provided by you at checkout.

You agree to promptly update your account information, including your email address, so that we can complete your transactions and contact you as needed.

SECTION 7 — THIRD-PARTY TOOLS AND LINKS

Our Products are designed for use within third-party software, including but not limited to DaVinci Resolve (Blackmagic Design). We are not affiliated with, endorsed by, or sponsored by Blackmagic Design or any other software vendor. Compatibility statements are provided in good faith based on the software versions tested at the time of release. We are not responsible for changes to third-party software that may affect compatibility.

Our website may contain links to third-party websites that are not affiliated with us. We are not responsible for the content, accuracy, or practices of any third-party site, and we disclaim all liability for any harm or damages related to the use of third-party services.

SECTION 8 — USER COMMENTS, FEEDBACK, AND SUBMISSIONS

If you send us creative ideas, suggestions, proposals, testimonials, before/after images, or any other materials (collectively, "Comments"), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate, and otherwise use those Comments in any medium, including for marketing and promotional purposes, with attribution where reasonable.

We are under no obligation to (1) maintain Comments in confidence, (2) pay compensation for Comments, or (3) respond to Comments.

You agree that your Comments will not violate any third-party rights, including copyright, trademark, privacy, or other proprietary rights, and will not contain unlawful, defamatory, or otherwise objectionable material. You are solely responsible for the accuracy of your Comments.

Your submission of personal information through the store is governed by our Privacy Policy, available at https://hugodurand.myshopify.com/policies/privacy-policy, in compliance with the General Data Protection Regulation (GDPR) and applicable French data protection law.

SECTION 10 — ERRORS, INACCURACIES, AND OMISSIONS

Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions related to Product descriptions, pricing, promotions, offers, or availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the site is inaccurate, at any time without prior notice (including after you have submitted your order).

In addition to other prohibitions set forth in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any international, national, or local laws or regulations; (d) to infringe upon our intellectual property rights or those of others; (e) to harass, abuse, harm, defame, or discriminate against any person or group; (f) to submit false or misleading information; (g) to upload or transmit malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, scrape, or otherwise interfere with the security or operation of the Service.

We reserve the right to terminate your access to the Service for violating any of the prohibited uses.

We do not guarantee that your use of our Service will be uninterrupted, timely, secure, or error-free.

The Products are provided "as is" and "as available", without any representation, warranty, or condition of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by applicable mandatory law.

To the fullest extent permitted by law, in no case shall Hugo Durand / CLEARAZUR, its affiliates, contractors, or service providers be liable for any indirect, incidental, punitive, special, or consequential damages of any kind, including but not limited to lost profits, lost revenue, lost data, or replacement costs, arising from your use of any Product or the Service, even if advised of their possibility.

Nothing in these Terms shall limit or exclude any liability that cannot be limited or excluded under applicable French law, including liability for gross negligence or willful misconduct.

SECTION 13 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Hugo Durand / CLEARAZUR from any claim or demand, including reasonable attorneys' fees, made by any third-party arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.

SECTION 14 — SEVERABILITY

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 15 — TERMINATION

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms at any time by ceasing to use the site.

If we determine, in our sole judgment, that you have failed to comply with any provision of these Terms, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and your license to use the Products will immediately terminate.

The provisions of these Terms which by their nature should survive termination (including, without limitation, the License, Intellectual Property, Limitation of Liability, and Governing Law sections) shall survive termination.

SECTION 16 — ENTIRE AGREEMENT

These Terms of Service, together with our Privacy Policy and any other policies posted on this site, constitute the entire agreement and understanding between you and us, superseding any prior agreements, communications, and proposals between you and us.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Products shall be governed by and construed in accordance with the laws of France.

In the event of a dispute, and after a prior attempt at amicable resolution, the competent courts of France shall have exclusive jurisdiction, subject to mandatory consumer protection rules of the consumer's country of residence within the European Union.

In accordance with Articles L611-1 et seq. of the French Consumer Code, consumers may also resort to a consumer mediator or to the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
